Right on the main sidebar of the site it says:
We do not respect DMCA, complaints related to such matters are thrown directly in the trash, by us and our hosts.
While I think that’s awesome, before I post something that might have copyrighted content, the sidebar lists the first rule of the site as:
No illegal content under Netherlands law
While I’m not a citizen of the Netherlands, I’m pretty sure that distributing copyrighted material is illegal under NL law.
So I did a little research… And, while I dont speak Dutch, I tried using Google Translate and I’m very sure that the distribution of copyrighted material is illegal in the Netherlands.
There might be legal grey areas or caveats I don’t understand. That’s why I’m making this post. What’s the official stance of Burggit on posting copyrighted material?
A lot of seedboxes are hosted in The Netherlands, from my understanding, its kind of an unenforced law, or selectively enforced.
As for how we can get away with it, it’s kind of simple and also cool. Our VPS host Privex is super chill, and we are signed up with them anonymously. Let’s say The Netherlands demanded Privex shut us down right away. Privex (who is based in Belize, which has no MLATs or other agreements with The Netherlands) would contact us and say “Hey, we gotta get you off this location, what do you want to do?” We would then easily hop ship to another location on Privex. We’ve actually been wanting to move to a Sweden VPS (who’s datacenter is also extremely chill) to have a little more freedom in that way.
But basically, we can do it because in a worst case scenario we’d just pop back up again. Whether that be on a different VPS, different location or even different host, and we’d be back in business within a few hours (probably significantly less)
Hope this could answer your question.
It did, thank you!
Glad I could help!
Pinged @Disabled@burggit.moe since this is his VPS.
I’d love to test the DMCA resilience.
Go right ahead, just try not to flood our storage. :P Try posting magnet links or .torrent files instead of say, a whole movie. Not that a whole movie would properly upload anyway.
Right. Our files have a 40MB filesize limit which is subject to change if we take on more and more traffic.
so i could use https://upload.shota.services/ to spread doom wads around?
Yep, I have no way of seeing what you upload. Just note there’s a max time of 14 days and a max upload limit of 50GB, but other than that, go ham.
thx
